Breaking ! Both Claimants successful in the Court of Appeal in McMenemy v NHS (Claimant successfully defended the appeal) and Reynolds v NHS (Claimant’s appeal allowed). New test of proportionality applies to post 1 April 2013 clinical negligence premiums. Callery v Gray and Rogers v Rogers v Merthyr Tydfil still good law post Jackson.
