Role & Responsibilities
Gary Redfern is a Senior Costs Draftsman and Negotiator with the Manchester office of Kain Knight.
Gary graduated from the University of Manchester in 2011 with a Bachelor of Laws (LLB) degree and subsequently went into the practice of legal costs with an established firm in Manchester. Since his traineeship Gary has developed his expertise in a number of areas, including high value and complex costs matters. In recent years Gary has also developed a specialism in After the Event (ATE) premium disputes and has been heavily involved at the forefront of key case law and decisions in this area. This began with Axelrod v University Hospital of Leicester NHS Trust (28 January 2016), which addressed the issue of whether the wording of a policy certificate was compliant with The Recovery of Costs Insurance Premiums in Clinical Negligence Proceedings (No. 2) Regulations 2013. Gary was also heavily involved in the Court of Appeal matter of Peterborough & Stamford Hospitals NHS Trust v McMenemy & Ors  EWCA Civ 1941 (28 November 2017), where the Claimants were successful in defending the recoverability of ATE premiums and the post-Laspo applicability of the long-established principles in Callery v Gray and Rogers v Merthyr Tydfil.
Following the decision in McMenemy all eyes now are on the Court of Appeal once more in the matters of West v Stockport NHS Foundation Trust (CoA ref: A2/2017/0928) and Demouilpied v Stockport NHS Foundation Trust (CoA: ref: A2/2017/0930) (in which Gary has also had significant involvement). Both of these matters will be heard together, albeit they are separate appeals in their own right, and will address the evidential threshold required when considering reasonableness in amount (West) and the application of the new proportionality test (Demouilpied) on post-LASPO block rated clinical negligence premiums.
Gary continues to enjoy handling a complex and varied caseload, with an emphasis on Commercial, Civil and Catastrophic Injury litigation, including costs management & budgeting and detailed assessment proceedings.
